  • Price 599 USD per employee per month

Deel says it owns entities in more than 130 countries, which puts it among the largest owned networks of any EOR provider. Its published EOR fee of USD 599 per employee per month is in line with the other large platforms, and contracts run month to month. It suits companies hiring both contractors and employees across several countries. Before signing, get the deposit amount and FX markup in writing, confirm that no offboarding fee applies, and check which of your countries run through a partner rather than a Deel entity.

90countries covered

  • Price 699 USD per employee per month

Remote employs your staff through entities it owns in every country where it offers EOR, and its terms leave indemnities for EOR services uncapped, so it ranks well on compliance. The cost is a list fee of USD 699 per employee per month, and the margin in its monthly FX rate is not published. Standard terms can be cancelled on 30 days' notice, but an order form with a minimum contract value commits you for its full term and renews at a higher price. Shortlist it if owned entities in every country matter most to you, and get the FX margin and any order form terms in writing before you sign.

Employment contracts

A written contract is required in Kenya for any employment of three months or more, and the EOR issues it as the legal employer. Your company signs a separate service agreement.

The terms set out role, salary in KES, working hours, leave, notice and any restrictive covenants. The EOR is the counterparty to the employee, which is what removes the need for your own entity.

English is the standard contract language for commercial roles.

Fixed-term contracts are permitted, but repeated renewals can create a legitimate expectation of renewal, so most EORs default to indefinite terms.

Probation

Probation in Kenya can run for up to 6 months. Notice during probation is at least 7 days or pay in lieu, but the terms must be stated in the contract.

Set probation from day one. An extension of up to 6 more months needs the employee's agreement, and probation cannot exceed 12 months in total.

The Employment and Labour Relations Court has ruled that employees on probation are still owed a fair hearing, so probation is not a free exit. Some EORs shorten it as policy because they, not you, carry the dismissal risk. Ask before you agree a start date.

Working time and overtime

The statutory week is 52 hours over six days, though most office roles contract for 40 to 45. Overtime is paid at 1.5 times the hourly rate, or double on rest days and public holidays.

Normal and overtime hours combined are capped at 116 in any two consecutive weeks.

Define normal hours in the contract, because overtime is measured against them. Senior roles often treat salary as covering extra hours, so put the position in writing either way.

Leave and public holidays

Employees get at least 21 working days of paid annual leave after 12 months of service, plus 12 public holidays. Sick, maternity and paternity leave sit on top.

The statutory floor is already high, and professional packages often sit at or a little above it, so budget on 21 days plus any contractual extras.

Paid sick leave is 7 days on full pay and 7 on half pay per year once the employee has two months' service. Maternity leave is 3 months and paternity leave 2 weeks, both on full pay and funded entirely by the employer, so confirm how the EOR bills them.

Termination and severance

Termination difficulty here is 4 out of 5. Notice is 28 days for monthly-paid staff, and redundancy severance is 15 days' pay per completed year of service.

Either side may terminate on notice or pay in lieu. Every dismissal needs a valid reason and a fair hearing, and the burden of proving both sits with the employer. Redundancy also needs a month's written notice to the labour officer.

The EOR runs the process as the legal employer and will want the paperwork in order, including final pay, unused leave and any contractual severance. Unfair termination awards can reach 12 months' gross pay, so keep a documented reason.

Statutory benefits

NSSF pension contributions and the Affordable Housing Levy are the main statutory employer costs, and they generally apply to foreign employees as well as citizens. Work injury cover under WIBA is mandatory on top.

Private medical cover and group life are standard for professional roles even though they are not mandatory. SHIF health cover is funded by a 2.75% deduction from the employee, not by the employer.

EORs often bundle benefits through a group scheme. Ask what is included in the fee and what is billed on top.

Payroll and tax

Payroll runs monthly in KES. Income tax is withheld at source through PAYE, at rates from 10% to 35%.

Employer contributions add 1.5% of gross for the Housing Levy, NSSF matched up to KES 6,480 a month, a KES 50 NITA levy and WIBA cover. That is before the EOR fee.

Remittance deadlines are the trap. PAYE, NSSF and SHIF are due by the 9th of the following month and the Housing Levy by the 9th working day, with penalties for late payment, so ask how the EOR evidences its filings.

Work permits

Foreign hires need a Class D work permit, and the sponsoring entity must show the role cannot be filled locally. Processing typically takes 2 to 4 months.

Ask whether the EOR sponsors directly or refers to a partner. A partner-model EOR often cannot sponsor at all, and the localisation test and understudy plan apply to the sponsor, not to you.

Set start dates after approval, not before.

Data protection

Employee data is processed under the Data Protection Act 2019, with the EOR acting as controller for employment records and processor for your instructions.

Get the data processing terms in the service agreement, not just the privacy notice. Cross-border transfers need a lawful basis and documented safeguards.

Ask whether the EOR is registered with the Data Protection Commissioner, where payroll data is hosted and who in the partner chain can see it.

When to open your own entity

The usual trigger in Kenya is 5 to 15 employees, or a permanent commercial presence. Below that, an EOR is normally cheaper and faster.

Incorporation here is straightforward, but the running cost is the point: KRA, NSSF, SHA and NITA registrations, a county business permit, accounting, audit and payroll software set an annual floor.

Permanent establishment risk is about what people do, not where payroll sits. Revenue-generating activity can create exposure regardless of the employment route.

G-P is one of the most compliance-focused EORs available, with over 100 of its own legal entities and a long record in heavily regulated countries. Its list price starts at USD 599 per employee per month, but independent reviewers report higher quotes, a one-off setup fee per hire, a deposit, an FX markup and an offboarding charge. Shortlist it if you’re a larger business that puts compliance ahead of cost, and get the full fee schedule in writing before you sign.

Oyster suits companies that want HR experts, legal support and termination handling included in one EOR fee, along with integrations for the most common HRIS and ATS platforms. The trade-offs are a USD 699 monthly list price, a refundable deposit of about one month's employment cost per hire, and EOR coverage of 120+ countries rather than the 180+ headline. There are no onboarding or offboarding fees, and monthly billing carries no minimum term.

Questions buyers ask about Kenya

How much does it cost to employ someone in Kenya through an EOR?
Budget the gross salary, plus the 1.5% Housing Levy, NSSF of up to KES 6,480 a month, the NITA levy and WIBA cover, plus the EOR fee. Published EOR fees sit in the 199 to 699 USD per employee per month band, or a percentage of payroll.
How long does it take to onboard an employee in Kenya?
Typically 2 to 7 working days once the candidate has accepted and right to work is confirmed. Work permit cases take considerably longer.
Can an EOR terminate an employee in Kenya?
Yes. Notice or pay in lieu applies and termination difficulty here is 4 out of 5, so the EOR will need a valid reason and a fair hearing to limit unfair termination exposure.
Does the EOR need its own entity in Kenya?
Someone in the chain must hold a local entity, and only that entity can sponsor a Class D work permit. Ask whether the provider owns it or uses a partner, in writing.
