  • Price 599 USD per employee per month

Deel says it owns entities in more than 130 countries, which puts it among the largest owned networks of any EOR provider. Its published EOR fee of USD 599 per employee per month is in line with the other large platforms, and contracts run month to month. It suits companies hiring both contractors and employees across several countries. Before signing, get the deposit amount and FX markup in writing, confirm that no offboarding fee applies, and check which of your countries run through a partner rather than a Deel entity.

  • Price 699 USD per employee per month

Remote employs your staff through entities it owns in every country where it offers EOR, and its terms leave indemnities for EOR services uncapped, so it ranks well on compliance. The cost is a list fee of USD 699 per employee per month, and the margin in its monthly FX rate is not published. Standard terms can be cancelled on 30 days' notice, but an order form with a minimum contract value commits you for its full term and renews at a higher price. Shortlist it if owned entities in every country matter most to you, and get the FX margin and any order form terms in writing before you sign.

Employment contracts

A written employment contract is required in Panama, and the EOR signs it as the legal employer. Your company signs a separate service agreement.

The contract sets out role, salary in USD, working hours, leave, notice and any restrictive covenants. The EOR is the counterparty to the employee, which is what removes the need for your own entity.

Spanish is the standard contract language, and the copy filed with the Ministry of Labour (MITRADEL) must be in Spanish. Contracts are signed in three copies: one each for the employer, the employee and MITRADEL.

Fixed-term contracts are capped at one year, or three years for roles that need special skills. Keeping someone on after the term ends makes the contract indefinite, so most EORs default to indefinite terms.

Probation

Probation in Panama is capped at 3 months. Either side can end the contract during it without notice or severance, but the clause must be in the written contract.

Set probation from day one. It cannot be extended beyond 3 months, and it is only valid for roles that need particular skills.

EOR policies on probation vary because they, not you, carry the dismissal risk. Ask before you agree a start date.

Working time and overtime

The standard week is 48 hours on the day shift. Overtime pay is statutory for most employees, with positions of trust excluded.

Overtime is paid at a premium of 25% to 75% depending on the shift, and is capped at 3 hours a day and 9 hours a week. Night and mixed shifts have shorter weeks of 42 and 45 hours.

Senior managers and positions of trust sit outside the hours limits, so overtime for those roles becomes a contractual matter rather than a statutory one. Put the position in writing either way.

Leave and public holidays

Employees get 30 days of paid annual leave for every 11 months worked, plus 12 national public holidays. Sick, maternity and paternity leave sit on top.

The statutory 30 days is already generous and is usually what professional roles receive, so budget for a full month away each year when you plan cover.

Paid sick leave runs to 18 days a year at the employer's cost, and unused days can be carried over two years. Maternity leave is 14 weeks, paid by the social security fund with the employer covering any shortfall, so confirm which side the EOR carries. Paternity leave is 3 days, paid by the employer.

Termination and severance

Termination difficulty here is 4 out of 5. Employees with under two years' service get 30 days' notice, and every exit from an indefinite contract triggers a seniority premium.

Without just cause, the employer owes notice or pay in lieu for staff under two years, plus an indemnity that rises with tenure to roughly 3.4 weeks' pay per year of service. After two years, employees gain job stability, so dismissal needs just cause or a negotiated exit.

The seniority premium of one week's pay per year is owed whatever the reason for leaving, and employers pre-fund it through a severance fund (fondo de cesantía). The EOR runs the process as the legal employer and will want the paperwork in order, including final pay, unused leave and the thirteenth-month balance. A just cause dismissal must state the reason in writing, so keep it documented.

Statutory benefits

Social security through the Caja de Seguro Social (CSS) is the dominant statutory cost and covers every employee, foreign hires included. The employer rate is rising in steps until 2029.

Private medical cover and group life are standard for professional roles even though they are not mandatory.

EORs often bundle benefits through a group scheme. Ask what is included in the fee and what is billed on top.

Payroll and tax

Payroll runs fortnightly or monthly in USD. Income tax is withheld at source, and employees with a single salary usually do not file a return.

Employer social security and education tax add 14.75% on top of gross salary, plus a professional risk premium set by business activity. That is before the EOR fee, and the employer CSS rate goes up a further point in March 2027.

The thirteenth month is the trap. It adds one month's pay a year, paid in three instalments on 15 April, 15 August and 15 December, so build it into the budget from the start.

Work permits

Foreign hires need residency and a work permit from MITRADEL, and the sponsoring entity must stay within foreign worker quotas. Processing can take 1 to 6 months.

Ask whether the EOR sponsors directly or refers to a partner. A partner-model EOR often cannot sponsor at all, and the quotas of 10% of ordinary staff and 15% of specialist staff apply to the sponsor, not to you.

Several regulated professions are reserved for Panamanian nationals, so check the role first. Set start dates after approval, not before.

Data protection

Employee data is processed under Law 81 of 2019, with the EOR acting as controller for employment records and processor for your instructions.

Get the data processing terms in the service agreement, not just the privacy notice. Cross-border transfers need consent or a recipient that meets equivalent standards.

Ask where payroll data is hosted and who in the partner chain can see it. The regulator, ANTAI, can fine and suspend processing.

When to open your own entity

The usual trigger in Panama is 5 to 15 employees, or a permanent commercial presence. Below that, an EOR is normally cheaper and faster.

Incorporation here is quick, but the running cost is the point: a resident agent, three directors, the annual franchise tax, a commercial licence, accounting and payroll software set an annual floor. Your own entity would also be bound by the foreign worker quotas.

Permanent establishment risk is about what people do, not where payroll sits. Revenue-generating activity can create exposure regardless of the employment route.

G-P is one of the most compliance-focused EORs available, with over 100 of its own legal entities and a long record in heavily regulated countries. Its list price starts at USD 599 per employee per month, but independent reviewers report higher quotes, a one-off setup fee per hire, a deposit, an FX markup and an offboarding charge. The trade-offs are a USD 699 monthly list price, a refundable deposit of about one month's employment cost per hire, and EOR coverage of 120+ countries rather than the 180+ headline. There are no onboarding or offboarding fees, and monthly billing carries no minimum term.

Questions buyers ask about Panama

How much does it cost to employ someone in Panama through an EOR?
Budget the gross salary, plus 14.75% in employer social security and education tax, a professional risk premium, the thirteenth month and the EOR fee. Published EOR fees sit in the 199 to 699 USD per employee per month band, or a percentage of payroll.
How long does it take to onboard an employee in Panama?
Typically 2 to 7 working days once the candidate has accepted and right to work is confirmed. Work permit cases take considerably longer.
Can an EOR terminate an employee in Panama?
Yes, but termination difficulty here is 4 out of 5. Staff under two years get notice or pay in lieu, staff over two years can only be dismissed for just cause or a negotiated exit, and the seniority premium is owed either way.
Does the EOR need its own entity in Panama?
Someone in the chain must hold a local entity, and only that entity can sponsor a work permit within its own quota. Ask whether the provider owns it or uses a partner, in writing.
